Terms of Service for Bracie

Please read these Terms of Service (“Terms”) carefully before using the Bracie mobile application (the “App”) operated by Bracie Ltd(“we”, “us”, or “our”). By accessing or using the App, you agree to be bound by these Terms.

1. Important: Medical & Safety Disclaimer

Bracie is an informational and tracking tool only. It is not a medical device and does not provide medical advice, diagnosis, or treatment.Always seek the advice of your orthodontist, dentist, doctor, or other qualified health provider with any questions regarding a medical condition. Never disregard professional advice or delay seeking it because of information in the App. Bracie is not for emergencies. If you require urgent help, contact emergency services immediately.

2. Eligibility & Caregiver Use

You must be legally able to accept these Terms. If the treatment recipient is under 13, the App should be set up and supervised by a parent or guardian.

3. Licence & Acceptable Use

  • We grant you a revocable, non-exclusive, non-transferable, limited licence to use the App for your personal, non-commercial purposes, subject to these Terms.
  • You agree not to misuse the App, reverse engineer it, or use it to store or transmit unlawful content.

4. Accounts

Bracie does not require a user account. Your content (e.g., visits, photos, notes) is stored on your device and can optionally sync via your personal iCloud account as described below.

5. iCloud Synchronisation

If you enable iCloud for Bracie in your iOS settings, Apple’s iCloud/CloudKit services sync your App data across your devices under your Apple account. You can disable iCloud for Bracie at any time in your device settings. We are not responsible for the availability, security, or performance of iCloud. Your use of iCloud is subject to Apple’s terms and policies.

6. Subscriptions, Purchases & RevenueCat

In-app purchases and subscriptions are billed through Apple and managed by Apple’s App Store. We use RevenueCatto validate purchases and manage entitlements. Prices, billing cycles, trials, renewals, and cancellation are governed by Apple’s terms. You can manage or cancel your subscription in your Apple ID settings. We do not process your payment card details.

7. Analytics & Personalisation (Optional)

Analytics and personalisation are off by default. If you opt in, we may collect pseudonymous product-interaction events to improve the App, and, if you additionally opt in to personalisation, we may use non-sensitive properties (e.g., caregiver status, age bracket, goals) to tailor in-app tips. You can change your choices in the App’s privacy settings. Analytics remain disabled for subjects under 13.

8. User Content

You retain all rights to content you add (e.g., photos, notes). You are responsible for ensuring you have the rights to that content and that it complies with law and these Terms. You grant us a limited licence to process your content solely to operate App features on your device and, if enabled, to facilitate iCloud sync.

9. Intellectual Property

The App (excluding your content), including software, design, and branding, is owned by Bracie Ltd and its licensors and is protected by intellectual property laws. Our marks and logos may not be used without our written permission.

10. Changes to the App

We may update or discontinue features at any time. Where changes are material, we will provide notice within the App or on our website.

11. Termination

We may suspend or terminate your access to the App if you materially breach these Terms or use the App unlawfully. You may stop using the App at any time. Upon termination, your licence ends.

12. Disclaimers

The App is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill, arising from your use of the App. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, or for death or personal injury caused by negligence.

14. Changes to These Terms

We may modify these Terms. We will post the updated Terms in the App or on our website. Changes apply from the stated effective date. If you continue using the App after changes take effect, you accept the updated Terms.

15. Governing Law

These Terms and any dispute or claim (including non-contractual disputes or claims) are governed by the laws of England and Wales. Courts of England and Wales shall have non-exclusive jurisdiction.
