Terms of Service for Bracie

Please read these Terms of Service (“Terms”) carefully before using the Bracie mobile application (the “App”) operated by Gourami Studio Ltd (“we,” “us,” or “our”).

Your access to and use of the App is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all users and others who wish to access or use the App. By accessing or using the App, you agree to be bound by these Terms.

IMPORTANT: Medical Disclaimer

The Bracie app is an informational and tracking tool only. It is not a medical device and is not intended to provide medical advice. The information and features within the App are not a substitute for professional orthodontic or medical advice, diagnosis, or treatment.

Always seek the advice of your orthodontist, doctor, or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on or tracked with the Bracie App. Gourami Studio Ltd is not responsible for any health problems that may result from information you obtain through the App.

Use of the App

• License: We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App for your personal, non-commercial purposes strictly in accordance with these Terms.
• User Responsibilities: You are responsible for maintaining the confidentiality and security of the data on your device. You agree to provide accurate information when logging visits and other data.

iCloud Synchronization

To provide a seamless experience across your personal Apple devices, the App automatically uses Apple’s iCloud service to synchronize your data if you are logged into an iCloud account on your device. Your use of this service is subject to the terms and conditions set forth by Apple Inc. You can manage this synchronization feature in your device’s main iCloud settings. We are not responsible for the availability or performance of the iCloud service.

Intellectual Property

The App, including its original content (excluding data provided by you), features, design, and functionality, are and will remain the exclusive property of Gourami Studio Ltd and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

Termination

We may terminate or suspend your access to the App at our sole discretion, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

Disclaimer of Warranties and Limitation of Liability

The App is provided to you “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind.

To the maximum extent permitted by applicable law, Gourami Studio Ltd, on our own behalf and on behalf of our affiliates, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the App. In no event shall Gourami Studio Ltd be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in any way related to your use of or inability to use the App.

Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms within the App or on our website: bracie.app By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the UK, without regard to its conflict of law provisions.
